These Terms of Use (“Terms”) govern your access to and use of Cashflow Scenarios, a service provided by Veylo LLC (“Veylo,” “Company,” “we,” “us,” or “our”).
For purposes of these Terms, “Cashflow Scenarios” refers to the website, application, features, tools, content, and related services we provide (collectively, the “Service”). “You” and “your” refer to the individual accessing or using the Service.
Please read these Terms carefully.
By creating an account, purchasing a subscription, clicking a button or checkbox indicating your acceptance of these Terms, or otherwise accessing or using the Service after being presented with these Terms, you agree to be bound by them.
If you do not agree to these Terms, you may not access or use the Service.
1. Privacy
Your privacy is important to us. Our Privacy Policy describes how we collect, use, store, and otherwise process information in connection with the Service.
Privacy Policy: /privacy
These Terms and our Privacy Policy should be read together.
2. About Cashflow Scenarios
Cashflow Scenarios is a personal financial planning and scenario-modeling tool intended to help users explore hypothetical changes to household cash flow.
Depending on the features available to your account, the Service may allow you to enter information regarding income, recurring bills, living costs, one-time events, and other financial assumptions; create and duplicate financial scenarios; compare scenarios; estimate changes in cash flow over time; store reusable financial information; share certain scenarios with other people; and use other planning, visualization, or analysis tools made available by the Service.
Features may change, be added, or be removed over time.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or use the Service.
The Service is currently intended for users located in the United States. You may not use the Service where your use would violate applicable law or regulation.
By creating an account, you represent that you satisfy these eligibility requirements.
4. Account Registration and Security
Certain features of the Service require an account.
You agree to provide accurate and current information when creating and maintaining your account. You are responsible for maintaining the confidentiality and security of your account credentials and for activity that occurs through your account.
You may not share your credentials in a manner that permits another person to impersonate you or bypass account, subscription, or usage restrictions.
Security contact: security@cashflowscenarios.com
You agree to notify us promptly at the address above if you reasonably believe that your account has been accessed or used without authorization.
To the fullest extent permitted by applicable law, Veylo is not responsible for losses resulting from unauthorized access caused by your failure to reasonably protect your credentials or devices.
5. Important Financial Disclaimer
CASHFLOW SCENARIOS IS A FINANCIAL PLANNING AND EDUCATIONAL TOOL. IT DOES NOT PROVIDE FINANCIAL, INVESTMENT, TAX, ACCOUNTING, LEGAL, CREDIT, LENDING, OR OTHER PROFESSIONAL ADVICE.
Veylo LLC is not acting as your financial adviser, investment adviser, broker, accountant, attorney, lender, fiduciary, or other professional adviser through your use of the Service.
The Service produces estimates, projections, comparisons, calculations, and other outputs based primarily on information and assumptions provided by you and the computational methods used by the Service.
Financial projections are inherently uncertain. Actual results may differ materially from a scenario shown in the Service because of changes in income, expenses, taxes, interest rates, inflation, timing, fees, unexpected events, incomplete information, inaccurate assumptions, calculation methodology, or other circumstances.
We do not independently verify the completeness or accuracy of the financial information you enter.
You are solely responsible for determining whether the information, assumptions, and outputs produced through the Service are appropriate for your circumstances.
You should not make significant financial, investment, borrowing, employment, housing, purchasing, or other decisions solely in reliance on a Cashflow Scenarios projection. Where appropriate, you should consult a qualified professional who can evaluate your individual circumstances.
No output generated by the Service constitutes a promise, guarantee, prediction, or representation regarding your future financial condition or results.
6. User Data
The Service allows you to submit and store information such as income amounts, bills, expenses, financial assumptions, scenario information, names or descriptions you assign to financial items, and other information you choose to provide (“User Data”).
As between you and Veylo, you retain your rights in your User Data.
You grant Veylo a limited, non-exclusive right to host, process, reproduce, transmit, and otherwise use User Data only as reasonably necessary to operate, maintain, secure, troubleshoot, support, and provide the Service, and as otherwise described in our Privacy Policy or required by law.
This license does not transfer ownership of your User Data to Veylo.
You are responsible for the accuracy, legality, and appropriateness of User Data that you submit to the Service.
You should not enter information that you do not have the legal right to use or disclose.
7. Scenario Sharing
The Service may allow you to share a scenario or portions of a scenario with another person.
You are responsible for deciding what information you choose to share and with whom you share it.
Before using a sharing feature, you should review the scenario and consider whether it contains financial or other information that you do not want another person to access.
Depending on how a particular sharing feature operates, people you authorize or people who obtain access to a valid sharing link may be able to view information contained in the shared scenario.
You are responsible for appropriately distributing and protecting sharing links and other access mechanisms made available to you.
Veylo is not responsible for the actions of a person with whom you voluntarily share your information, including that person’s copying, saving, disclosing, or otherwise using information after receiving lawful access to it.
We may disable or restrict sharing features when reasonably necessary for security, abuse prevention, legal compliance, maintenance, or operation of the Service.
8. Acceptable Use
You may use Cashflow Scenarios only for lawful purposes and in accordance with these Terms.
You may not:
- use the Service to violate applicable law;
- gain unauthorized access to another person’s account or information;
- submit information that you do not have the right to use;
- circumvent account, subscription, feature, rate, or usage restrictions;
- interfere with the security or normal operation of the Service;
- probe, scan, or test vulnerabilities without our written authorization;
- introduce malicious software or harmful code;
- scrape, crawl, harvest, or automatically extract information except where expressly authorized by us;
- reverse engineer, decompile, or attempt to derive the source code of the Service except to the extent such restriction is prohibited by law;
- impersonate another person or misrepresent your affiliation with another person or organization;
- use the Service to harass, defraud, threaten, or harm another person; or
- use the Service in a manner that imposes an unreasonable burden on our infrastructure.
Unless we expressly authorize otherwise, Cashflow Scenarios is licensed for personal and household use and not for resale, sublicensing, service-bureau use, or the operation of a competing product or service.
We may investigate suspected misuse and may restrict or terminate access when we reasonably believe these Terms have been materially violated.
9. Subscriptions and Paid Features
Cashflow Scenarios may offer free and paid plans with different features, limits, or entitlements.
The price, billing interval, included features, and other material terms of a paid subscription will be disclosed before purchase.
When you purchase a recurring subscription, you authorize us and our payment processor to charge the payment method associated with your account for the applicable subscription fees and taxes.
Unless otherwise stated when you subscribe, paid subscriptions automatically renew for successive billing periods until canceled.
You may cancel a recurring subscription using the cancellation or billing functionality provided through the Service. Cancellation prevents future renewal charges and normally takes effect at the end of your then-current paid billing period unless otherwise stated or required by law.
Unless otherwise expressly stated at the time of purchase or required by applicable law, subscription payments are non-refundable and we do not provide prorated refunds for unused portions of a billing period.
If a payment cannot be successfully processed, we may retry the payment and may restrict, downgrade, or suspend paid features until payment is successfully completed.
We may change subscription prices or plan structures from time to time. Any price change affecting an existing recurring subscription will take effect no earlier than permitted by applicable law and after any notice we are required to provide.
The specific features and usage limits associated with a subscription tier may change over time. We will not intentionally charge you a new subscription price without providing the disclosures or authorization required by applicable law.
10. Account Cancellation and Termination
You may stop using the Service at any time.
Where account-deletion functionality is available, you may request deletion of your account through the Service.
Deleting your account and canceling a paid subscription are separate actions unless the Service expressly states otherwise. You should cancel any active recurring subscription before or in connection with deleting your account as directed by the Service.
When an account is deleted, User Data associated with the account will be handled in accordance with our Privacy Policy, applicable law, legitimate security and fraud-prevention requirements, and any legal or recordkeeping obligations that apply to us.
We may suspend or terminate an account if we reasonably determine that the user has materially violated these Terms, created a security or legal risk, engaged in fraud or abuse, failed to pay applicable fees, or used the Service in a way that could materially harm Veylo, the Service, another user, or a third party.
Where reasonably practicable, we may provide notice before terminating an account, but we reserve the right to take immediate action when necessary to address security threats, fraud, unlawful activity, abuse, or other serious risks.
11. Service Availability, Changes, and Data Loss
We work to make Cashflow Scenarios available and reliable, but we do not guarantee uninterrupted or error-free operation.
The Service may occasionally become unavailable because of maintenance, software defects, infrastructure problems, security events, third-party service failures, Internet outages, or circumstances outside our reasonable control.
We may modify, update, suspend, discontinue, or replace features of the Service from time to time.
While we may use reasonable technical measures intended to protect and maintain information stored through the Service, no online service can guarantee that information will never be lost, corrupted, deleted, delayed, or made temporarily unavailable.
You are responsible for maintaining independent records of financial information that is important to you and should not use Cashflow Scenarios as your sole permanent repository for critical financial records.
12. Third-Party Services
The Service may rely on or interact with third-party providers for functions such as hosting, databases, authentication, payments, email delivery, analytics, security, and other infrastructure.
We may also provide links to third-party websites or resources for convenience.
Third-party services are operated independently from Veylo and may be subject to their own terms and privacy practices.
To the fullest extent permitted by law, Veylo is not responsible for the availability, security, accuracy, acts, omissions, products, services, policies, or content of independent third parties.
The inclusion or use of a third-party service does not necessarily constitute an endorsement of that third party.
13. Intellectual Property
Except for User Data and third-party materials, the Service and all associated software, source code, designs, interfaces, graphics, text, branding, trademarks, documentation, features, and other materials are owned by or licensed to Veylo and are protected by applicable intellectual-property laws.
Subject to these Terms, Veylo grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to access and use the Service for its intended purpose.
No ownership interest in Cashflow Scenarios or Veylo intellectual property is transferred to you.
All rights not expressly granted under these Terms are reserved.
If you voluntarily send us suggestions, ideas, or product feedback specifically for the purpose of helping us improve the Service, you agree that we may use that feedback without restriction or compensation to you. This provision does not claim ownership of your User Data or of reviews or opinions you publish about Veylo or Cashflow Scenarios.
14. Electronic Communications
By creating an account or using the Service, you consent to receive transactional and administrative communications from us electronically, including account-verification messages, password-reset messages, security notices, billing notices, service announcements, and notices concerning these Terms or the Service.
Electronic communications may be delivered to the email address associated with your account or through the Service.
You are responsible for keeping your account email address current.
Transactional or legally required communications may be sent even if you have opted out of optional marketing communications.
If we send marketing communications, you may opt out using the unsubscribe mechanism provided in those communications where required.
Nothing in this section limits rights that cannot legally be waived.
15. Warranty Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
Veylo makes no express or implied warranty regarding the Service, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, security, or that the Service will satisfy your particular needs.
Without limiting the Financial Disclaimer above, we do not warrant that calculations, projections, estimates, comparisons, or other outputs will be complete, accurate, current, or suitable for any particular financial decision.
We do not warrant that the Service will operate without interruption, delay, vulnerability, data loss, or error.
Some jurisdictions do not allow the exclusion of certain warranties, so portions of this section may not apply to you.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Veylo LLC and its affiliates, members, managers, officers, employees, contractors, agents, licensors, service providers, successors, and assigns (collectively, the “Veylo Parties”) will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, opportunities, goodwill, use, or data, arising from or relating to the Service or these Terms.
This includes, without limitation, losses arising from your reliance on a financial projection or calculation; financial decisions made using information from the Service; inaccurate or incomplete User Data; unauthorized account access; information you voluntarily share with another person; interruption or unavailability of the Service; loss or corruption of information; or the acts or omissions of third-party service providers.
To the maximum extent permitted by applicable law, the aggregate liability of the Veylo Parties for all claims arising out of or relating to the Service or these Terms will not exceed the greater of $100 or the amount you paid to Veylo for the Service during the twelve months immediately preceding the event giving rise to the claim.
The limitations in this section apply regardless of the legal theory asserted and even if a Veylo Party has been advised that such damages are possible.
Nothing in these Terms excludes or limits liability to the extent such liability cannot legally be excluded or limited.
17. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Veylo Parties from claims, liabilities, damages, judgments, losses, costs, and reasonable expenses arising out of or relating to your unlawful or unauthorized use of the Service; your material violation of these Terms; your violation of another person’s rights; User Data you submit without the legal right to do so; or your misuse of scenario-sharing functionality.
Veylo reserves the right to assume control of the defense of a matter otherwise subject to indemnification, in which case you agree to reasonably cooperate with that defense.
18. Suspension or Discontinuation of the Service
We do not promise that Cashflow Scenarios will operate indefinitely.
We may suspend or discontinue some or all of the Service for legitimate business, technical, security, legal, or operational reasons.
If we permanently discontinue a paid Service, we will handle prepaid amounts, if any, in accordance with applicable law and any commitments communicated to affected subscribers.
19. Changes to These Terms
We may update these Terms from time to time.
When we make material changes, we will take reasonable steps to provide notice, which may include posting the updated Terms through the Service, updating the effective date, displaying an in-product notice, or sending notice to the email address associated with your account.
Where applicable law requires additional consent to a change, we will request that consent.
Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
If you do not agree to revised Terms, you should stop using the Service and cancel any applicable subscription before its next renewal.
20. Governing Law and Disputes
These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws of the State of Michigan, without regard to its conflict-of-law principles, except to the extent federal law applies or applicable law requires otherwise.
Before filing a legal action, you and Veylo agree to make a reasonable good-faith effort to resolve the dispute informally.
Informal dispute contact: legal@cashflowscenarios.com
A user may initiate informal resolution by contacting us at the address above and describing the dispute and requested resolution.
Unless applicable law requires otherwise, any judicial proceeding arising out of or relating to these Terms or the Service will be brought in the appropriate state court located in Kalamazoo County, Michigan, or the applicable United States District Court in Michigan, and you and Veylo consent to personal jurisdiction and venue in those courts.
Nothing in this section prevents either party from seeking appropriate relief in small-claims court where eligible or from seeking emergency injunctive relief where legally appropriate.
21. Consumer Rights
Nothing in these Terms is intended to waive rights or remedies that cannot legally be waived under applicable federal or state consumer-protection law.
Nothing in these Terms restricts your right to provide an honest review, rating, opinion, or assessment of Cashflow Scenarios or Veylo.
22. General Terms
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted, and the remaining provisions will remain in effect.
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Veylo may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, financing, or transfer of the Service or relevant business operations.
We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including failures of communications networks or infrastructure, natural disasters, governmental actions, labor disputes, widespread Internet or cloud-service outages, war, civil unrest, or other force majeure events.
Provisions that by their nature should survive termination—including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and general legal terms—will survive termination.
These Terms, together with any additional terms expressly presented to you in connection with a particular feature or purchase, constitute the entire agreement between you and Veylo regarding the Service and supersede prior agreements or communications concerning the same subject matter.
